These Terms apply to PairWorks Labs LLC, doing business as GuardPair, and govern use of the GuardPair website, applications, marketplace, booking tools, payment tools, messaging, check-in, location, reporting, and related software.
GuardPair is marketplace technology. It does not provide private security services, employ guards, act as a security agency, or guarantee a provider’s work. Businesses and providers are responsible for evaluating and performing their own arrangements.
GuardPair does not supervise, direct, employ, control, or guarantee businesses, security companies, independent guards, or their personnel. Providers independently determine how to perform accepted services and remain solely responsible for staffing, conduct, licensing, permits, insurance, training, equipment, taxes, and legal compliance. GuardPair verification indicates only that submitted information passed the platform review described at that time; it is not an endorsement or guarantee.
Providers are responsible for required licenses, permits, training, insurance, staffing, tax obligations, and lawful service delivery. Businesses are responsible for booking instructions, site conditions, payments, and selecting providers suitable for their needs.
A booking is formed when the required booking confirmation and checkout are completed. Unless checkout states otherwise, GuardPair charges a disclosed 15% platform fee. Stripe controls payment processing, payout timing, refunds, disputes, holds, and chargebacks.
GuardPair may offer promotional referral credits under the eligibility rules and reward amounts displayed in the app. A referral qualifies only when a genuinely new user joins with a valid referral code and completes the required paid booking through GuardPair. Cancelled, refunded, disputed, reversed, duplicate, self-referred, fraudulent, or otherwise ineligible activity does not earn a reward. Referral credits are promotional, non-transferable, and have no cash value except where required by law. GuardPair may withhold or reverse credits obtained through error, abuse, misrepresentation, or violation of these Terms.
Messaging, check-in, reports, and location sharing may be provided for confirmed active bookings. Location sharing requires provider permission and is intended only for the authorized booking.
Payments, payouts, maps, geocoding, identity or credential tools, notifications, hosting, storage, and other features may be supplied by independent third parties, including Stripe. GuardPair does not control those services, and their availability and use may be governed by separate terms and privacy policies. GuardPair is not responsible for a third party’s acts, omissions, outages, holds, decisions, or service performance to the maximum extent permitted by applicable law.
GuardPair provides its marketplace and software on an “as available” basis and does not guarantee that a provider will accept, attend, staff, complete, or safely perform any booking. To the maximum extent permitted by applicable law, GuardPair is not liable for the acts, omissions, conduct, performance, licensing, staffing, or services of independent providers or businesses using the platform, or for indirect, incidental, special, consequential, exemplary, or punitive damages. Nothing in these Terms excludes liability that applicable law does not permit GuardPair to exclude.
Except for claims eligible for small-claims court and claims that applicable law does not permit to be arbitrated, disputes arising from these Terms or GuardPair must be resolved through final and binding arbitration on an individual basis under the Federal Arbitration Act. No party may bring or participate in a class, collective, consolidated, or representative action in arbitration or court. Before filing, the claimant must send a written notice describing the dispute to support@guardpair.com and allow 30 days for informal resolution. Arbitration will be administered by the American Arbitration Association under the rules applicable to the claim. Users may opt out of this arbitration section by emailing the same address within 30 days after first accepting this version of the Terms, including their account email and a clear opt-out request. If a court finds part of this section unenforceable, the remaining enforceable terms remain in effect.
GuardPair may suspend accounts, hide profiles, cancel bookings, or restrict access for safety, verification, payment, legal, or policy reasons. Users may not submit false documents, misuse data, evade fees, or move platform-introduced bookings off platform to avoid fees.
